These Terms of Service ("Terms") govern your use of Perchance AI ("the App"), operated by Perchance AI ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Description of Service

Perchance AI is an AI-powered image generation application. Users provide text prompts, and the App generates images using machine learning models. The App is available on iOS via the Apple App Store.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

3. Account and Usage

The App uses anonymous authentication. You do not need to create a traditional account. Your usage data and generated images are stored locally on your device unless otherwise specified.

4. Subscriptions and Payments

• The App offers auto-renewable subscription plans (weekly and yearly) that unlock premium features including unlimited image generations.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions in your device Settings > Apple ID > Subscriptions.
• No refunds are provided for partial subscription periods. Refund requests must be directed to Apple.
• Free trial periods, if offered, automatically convert to a paid subscription unless canceled before the trial ends.

5. Acceptable Use

You agree not to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Generate content that infringes on intellectual property rights of third parties.
• Generate content depicting minors in inappropriate contexts.
• Attempt to reverse-engineer, decompile, or disassemble the App or its underlying AI models.
• Use the App for any purpose that violates applicable laws or regulations.

6. Generated Content

Images generated using the App are created by AI models. You may use generated images for personal and commercial purposes, subject to these Terms. We do not claim ownership of images you generate. However, we do not guarantee that generated images are free from resemblance to existing copyrighted works.

7. Intellectual Property

The App, including its design, code, features, and branding, is owned by us and protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. AI-generated content may be inaccurate, biased, or unexpected.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, profits, or business opportunities.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the App or by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the service.
